Which trademark class do I need in India? India follows the NICE Classification — 45 classes, 1–34 for goods and 35–45 for services — and you file (and pay) per class. Most businesses need more than one: a software product, for example, typically spans Class 9 (downloadable software), Class 42 (software-as-a-service) and Class 35 (business/retail services). This tool suggests the likely classes and drafts the goods/services wording; a Legismith attorney confirms it and quotes the filing, fixed, within 24 hours.
Refine with AI — free. Reads your website (if given) and rewrites the goods/services in expert attorney language.
Private & free — no sign-up, no email, and nothing you type or your result is stored. The classification is generated on the spot and then discarded. AI-assisted — results may contain errors, are not legal advice, and create no attorney–client relationship; a Legismith attorney verifies the classification and wording before filing. Please don’t enter confidential or unfiled information.

How trademark classes work

Picking the right class is where objections are won or lost

File in every class you trade in. A trademark only protects the goods and services you register it for. Register too narrowly and a competitor can use your name on adjacent products; register in the wrong class and you pay again to correct it. The tool errs towards showing the full set of classes a business like yours usually needs.
Wording matters as much as the number. Indian examiners object to vague or non-standard goods/services. Descriptions built from accepted NICE and WIPO terms clear examination faster — which is why this tool drafts from accepted-term language rather than free prose.
NICE 13th edition (2026) is current. It moved eyewear and optical goods from Class 9 to Class 10 and added AI-as-a-service to Class 42, among other changes. India applies the NICE Classification, but the Registry and examiner have the final say on class and specification.

Trademark classes — common questions

As many as cover what you actually sell. A single physical product may need just one class, but most modern businesses need two to four — for example a software company usually files in Class 9, Class 42 and Class 35, and a food brand often needs Class 29 or 30 plus Class 35 for retail. You file and pay per class.

No. It is an expert-informed starting point built on the NICE Classification. Classification is partly a matter of judgement, and the Indian Registry has the final say, so a Legismith attorney reviews the classes and the wording, runs a clearance search, and confirms before filing.

Because the examiner assesses the specification, not just the class number. Vague or non-standard descriptions draw objections that delay registration. Wording drawn from accepted NICE and WIPO terms is far more likely to be accepted as filed.

The 13th edition, 2026 (NCL 13-2026), the version in force from 1 January 2026. India follows the NICE Classification. Where a term sits on an edition boundary, the tool flags it for attorney review.
