Copyright Registration Process in India
Step 1: File Application
Submit your copyright application along with all required documents and supporting materials. Pay the prescribed government fees as per the current fee structure set by the Copyright Office.
Step 2: Diary Number Issued
The Copyright Office acknowledges receipt of your application and assigns a unique diary number. This diary number serves as your official reference for tracking the application status throughout the process.
Step 3: Public Objection Period
A mandatory 30-day waiting period begins where your application is open for public scrutiny. During this time, any third party can file objections if they believe your work infringes their rights.
Step 4: Objection Review
The Copyright Office examines all objections filed during the waiting period, if any. The Registrar determines whether a formal hearing is required to resolve the disputes.
Step 5a: Application Accepted (No Objections)
If no objections are filed or existing objections are resolved in your favor, your application proceeds smoothly. The case moves directly to the final registration approval stage without further complications.
Step 5b: Hearing Process (Objections Filed)
A formal hearing is conducted by the Copyright Registrar where both parties present their cases. You and the objecting party can submit evidence and arguments to support your respective positions.
Step 6a: Registration Certificate Issued (Success)
The Copyright Office grants you an official copyright registration certificate upon successful completion. Your legal protection rights are now activated, giving you exclusive rights over your creative work.
Step 6b: Application Rejected (Failure)
If objections are upheld by the Registrar after hearing, your application is rejected. The copyright registration is denied, and you do not receive legal protection for your submitted work.
